We will not be responsible for the content expressed on those sites and any other products and services which they may endorse. You agree to any information you have entered on this site being stored in a database. While this information will not be disclosed to any 3rd party as outlined in our Privacy Policy without your consent, we cannot be held responsible for any hacking attempt or system failure that may lead to the data being compromised or lost. Finally, we will not be held legally responsible for any banning or forum account deletion you receive from this site.

4. Limitations

In no event shall #1 Chat Avenue be liable for any damages (including, without limitation, damages for loss of data or profit, due to business interruption, or criminal charges filed against you) arising out of the use or inability to use the content on #1 Chat Avenue's website, even if #1 Chat Avenue or a #1 Chat Avenue authorized representative has been notified orally or in writing of the possibility of such damage. The materials appearing on #1 Chat Avenue's website could include technical, typos, or image errors. #1 Chat Avenue does not warrant that any of the content on its website are accurate, complete, or current. #1 Chat Avenue may make changes to the content on its website at any time without any notice. #1 Chat Avenue does not, however, make any commitment to update the content.

#1 Chat Avenue has not reviewed all of the sites linked from its website and is not responsible for the contents contained within. The inclusion of any link does not imply endorsement by #1 Chat Avenue. Use of any such linked web site is at the user's own risk.

7. Age Restrictions

Our applications and website has a minimum age requirement of 13 years. No sections are specifically targeted at, or intended for use by, "children" or "preteens" under the age of 13. We do not believe users under the age of 13 should be participating in live chat sessions at that age. This website is a general audience website intended for many age groups but the 12 and under age group is not one of them. Depending on the actual chat room, the demographics can vary. For example, for the Teen Chat, 13 year old kids and teens or 14 year old kids and teens are allowed to participate on their own accord. We have blocked out users declared under 13 from logging in or registering on our chat rooms or forums. There are other various warnings and tools that have been implemented throughout the website to ensure that users fully understand this age restrictions and limitation. We do not knowingly allow anyone under this age to use our website. If known, either through discovery or a report submitted to us, the account will be terminated as soon as reasonably possible. If you, as a parent or guardian, have discovered that a child (who is under 13) has registered for a chat account or message forum account using a false age to bypass our age check, please contact us with your child's message forum username or chat username and we will have that account and any message postings he/she made deleted. An investigation and conclusion that the user is indeed under the age of 13 needs to be processed first but will be actioned promptly.

Important Note: The Teen chat is for older kids, youths and teenagers. Specifically, users aged 13-19 years old. Again, it not directed to users deemed as "young children" which would encompass users of a much younger age and below 13 years of age. Our moderators will, on occasion, implement their own age verification process via the private messaging system to prevent users under the age of 13 to continue to participate. This will only be used if an administrator or moderator suspects the user to not meet the age requirements. Moderators will also action submitted reports of when a user is known or self declared in text that they do not comply with the age restrictions of our website. Our reporting system will directly submit their age declaration to a moderator for review. Our moderation team has also been instructed to verify and action any users who they might suspect as being overage or underage for a particular chat room. You must be a registered user in order to chat in this room. In order to participate in private chat, some chat rooms may require to declare your age. By default, private messaging cannot be made between those users 18 and over and 16 and under.

There are several rooms which are strictly for users 18 and over. They are the Adult Chat, the Gay Chat, and sex chat rooms. Due to the content of the rooms, they are constantly monitored and strictly enforced to ensure users underage will be removed. However, you, as a user, will be held solely responsible for your actions if you participate in those chat rooms.

8. User Generated Content

You may not post, submit or upload user generated content that is illegal, defamatory, harassing, violent, obscene, or otherwise offensive or harms other users or people in any way. This applies to all content whether or not such content is protected by law. We reserve the right to edit or remove any profile or content that we deem to be inappropriate or illegal material. This includes about me sections, user profile moods or profile/background pictures, forum signatures or blog comments. It is solely based on our own discretion. We may also take a snapshot of the content if we feel it is necessary for submission towards any future legal proceedings held against you.

Child Sexual Abuse Material (CSAM) is strictly prohibited. Any uploads to our platform of this material including, but not limited to, the intended sale or distribution of CSAM will be met with strict force. Your IP address and any other information we have on you will be forwarded to the appropriate online agencies and law enforcement. Please refer to our Standards Against Child Sexual Abuse and Exploitation.

a. Hateful Content

#1 Chat Avenue does not tolerate any form of hateful or violent content in our chat rooms or on our forums. This includes threats, promotion of violence or direct attacks towards other users based upon ethnicity, race, religion, sexual orientation, religion affiliation, age, disability, serious diseases and gender. Users also are prohibited from using hateful images for their profile pictures/avatars. This includes usernames. All such comment will be removed when noticed or reported to our staff. Discussion of sensitive topics such as Suicide and firearms or terrorism is forbidden as well.

b. Illegal Content

#1 Chat Avenue has a zero-tolerance policy for any form of illegal content in our chat rooms, forums, or anywhere on our platform. Users are strictly prohibited from using, uploading, or sharing illegal images, including child pornography (also known as Child Sexual Abuse Material or CSAM) and any other illegal content. This prohibition applies to all content types, including profile pictures, avatars, image uploads or transfers, as well as usernames and account nicknames.

If you encounter any pornographic material involving minors or children, please report it immediately to our Administrator at [email protected]. Users who post illegal content will face consequences such as being kicked, banned, and, in most cases, reported to law enforcement and relevant authorities.

#1 Chat Avenue is committed to removing all illegal content promptly once discovered or reported. While we cannot be held responsible for user-posted illegal content, we will take swift action against those responsible. It is essential that all illegal content be reported to our staff through the proper channels as soon as it is noticed. We will respond and act on reports within a reasonable timeframe.

All illegal content will be promptly removed from our servers and platform by our support team as quickly as possible. To help protect our community and comply with legal requirements, we also use automated software to detect CSAM and other prohibited materials. Upon detection, we reserve the right to remove such content immediately, suspend or terminate offending accounts, and report incidents to appropriate authorities as required by law.

c. Explicit content

In general, this website prohibits the use of explicit content including anything sexual, racial and hateful. If there are any exceptions we would specifically specify that. Some chat rooms do allow legal sexually explicit content, If explicit content is posted in a chat room, blog or forum that is forbidden by our rules or illegal by law, you will be subject to a kick or permanent ban of your account. Further action may be taken, including but not limited to, contacting law enforcement and/or agencies such as the National Center for Missing & Exploited Children (NCMEC) for the uploading, distribution or promotion of Child Sexual Abuse Material (CSAM). We will then share all information that we have on your with these agencies.

d. Selling of Goods or Services

We do not allow selling of any sort of services or goods through our platform including advertising and promotional materials and content. This encompasses all channels we offer here (forums, blogs or chat). Selling of sexual or illegal material or services is subject to referral to law enforcement (in addition to a permanent ban). That is a major violation of, not only our website, but many local laws.

e. Intellectual Property Rights

We do not allow posting of content that violates third-party intellectual property rights. If you do not own the content, please do not post it.

f. Personal Details or Information

Do not post somebody's personal or private details or information. This includes yourself and third parties.

g. Trading

We do not allow the exchange/trade of any physical or digital items including photos or links to images or other content. The mention of such phrase as MEGA or STR (S2R) (which are known to imply the trading of illegal content) are strictly forbidden.

h. Images of Minors in Our Adult Rooms

Several of our chat rooms are for adults only. In those rooms, pictures of children have no place even when they are entirely innocent. This means no family photographs, no baby or school pictures, no "this is my kid", and no images of anyone under 18 in a profile picture, a background image, an upload, a webcam broadcast, or the chat itself.

We enforce this for a simple reason: images posted in an adult room are copied by people you cannot see and cannot get them back from. An innocent photograph does not stay innocent once it has been taken somewhere else. We would rather be strict about this than explain later why a child's photograph was circulating.

• Images of minors posted in an adult room are removed, whether or not anyone reports them.
• Posting them deliberately, or repeatedly, will result in removal of the account.
• Sexual imagery of a minor is a separate matter entirely. It is illegal, it results in an immediate permanent ban with no warning and no appeal, and it is reported to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
• This rule is in addition to, not instead of, the age limit for each room. Check the Terms of Service for the room you are using — they are all linked at the bottom of this page.

Report Terms of Service Violations

As specified throughout the website, please report any violation of terms of service violation to our moderation team using the tools found within the chat software and the chat forums. We also staff hundreds of moderators throughout the chat rooms which can be contacted when active in the chat rooms or on the chat forums.

9. Governing Law

Any claim relating to #1 Chat Avenue's web site shall be governed by the laws of the location of its webhosting servers without regard to its conflict of law provisions.

11. Use of images and linking to our website

The logo(s) of #1 Chat Avenue is under free-license to use for the purposes of representation and association (linking or related articles) with this website. Linking from other websites to this website is allowed. Alterations of the logo for other uses or misrepresentation of this website through the use of unapproved logos is strictly prohibited.

12. Monitoring

This website has chat moderators and administrators in every room. Every attempt is made to ensure full 24 hour coverage. This website will not be held responsible for criminal offences committed by users who abuse our service. We reserve the right to take appropriate legal action, including referral to law enforcement agencies for any crimes or abuse committed on our website. Our moderation team takes a pro-active approach to monitoring our chat rooms. We encourage users to refer all violations of terms of service to our moderation team. If you are part of an official law enforcement agency and need more information about a user with regards to an investigation or would like to coordinate an operation to assist in catching predators, please visit our Law Enforcement page for more information.

13. Protecting Children

We protect children below the age of 18 from illegal content by:

Our website prohibits pornographic and other adult material in any area of our service that may be accessed by children, and we maintain clear, easy-to-use reporting tools so users can quickly flag content or behaviour of concern. We also provide block features to help users control who can contact them, and we have safeguards in place to reduce the risk of older users messaging younger users in private settings. In addition, we proactively monitor chat rooms, forums, and blogs for illegal content or behaviour, and we use moderation tools, including automated systems, AI, and hash matching against lists of known child sexual abuse material, to help identify and remove harmful material swiftly when it is reported or otherwise discovered.

#1 Chat Avenue also deploys an automated CSEA detection system across our platform. It examines messages, including private messages, for the indicators of child sexual exploitation and abuse — the patterns of grooming, sexual solicitation, and the trading or selling of child sexual abuse material. Matches are assessed in context and routed to a review queue where a trained human reviewer reads them and makes the decision. In addition, images uploaded across our domain are automatically scanned against hash lists of known child sexual abuse material maintained by child protection organisations, so that known material is identified even where it has never been reported to us. 14. Enforcement Actions

We enforce our child safety protections through a combination of proactive monitoring, prompt moderation action, and cooperation with law enforcement agencies worldwide. When content or conduct is reported to us by users, or identified by our moderation team or automated tools, we remove it swiftly and take appropriate enforcement action against the responsible account. We report illegal activity to the National Center for Missing & Exploited Children (NCMEC) and to other appropriate authorities as required by law, and we cooperate directly with verified law enforcement personnel investigating offences against children, giving investigators the access and support they need to carry out that work on our platform. A report to NCMEC is not limited in its effect to the United States: where a report concerns a user in another country, NCMEC forwards it to the law enforcement agency with jurisdiction in that country. A report involving a user in the United Kingdom, for example, is passed to the National Crime Agency (NCA). Our enforcement approach is designed to ensure that our child safety rules are applied in practice, not just stated in policy, and that harmful users and content are addressed as quickly as possible. The cooperation we have with law enforcement around the world has led to the arrests of hundreds of individuals in recent years. We look forward to continued cooperation with law enforcement agencies around the world in support of online safety.

15. User Risk

16. VIP Membership

This website offers VIP membership on some of our chat rooms. #1 Chat Avenue reserves the right to terminate a VIP membership at its sole discretion. Some reasons may include fraudulent purchase, violation of our rules and regulations, and violation of our terms of service. If you are banned for violating our terms of service or rules and regulations, refunds will not be given. If you do not log into your account for 3 months or more, we also reserve the right to terminate your VIP account.

VIP membership is available to registered members only. You must create an account and be signed in to it in order to upgrade to VIP; guest users cannot subscribe to VIP membership, and VIP cannot be gifted to a guest account.

VIP membership adds features in the chat rooms where it is offered. It does not grant any exemption from our rules. This site's Terms of Service, the rules of each chat room, and the instructions of our moderators apply to VIP members in exactly the same way as they apply to every other user. Holding a VIP membership will not prevent a kick, a ban, or any other enforcement action where our rules have been broken, and as set out above, refunds are not given in those circumstances.

The functions and features given to VIP members are subject to change at any time. This may include the removal or addition of features. It is in our sole discretion. The functions and features listed are at the time of purchase. Updates happen from time to time and those features may be subject to change. In the vast majority of cases, only additional features are added for the benefit of the VIP member.

All payments must be used with an authorized credit card or debit card. Use of fraudulent cards are illegal. If you are using the debit or credit card of a family member, that is allowed, however, please inform them and receive permission first. You can also allow them to process the transaction on your behalf. We reserve the right to verify all purchases. If we find anything that does not satisfy us that the transaction was legitimate, we may terminate the VIP.

The above terms will also apply to any VIP gifts that are made to other users of this website.

VIP gifted to your account cannot be removed upon request. As part of your agreement to use this website, you also agree that your account can be subject to a VIP gifted to your account. You are welcome to set your account on delete or cease to use the account permanently.

VIP memberships or anything else purchased on this site (such as gold) may not be sold or exchanged with other members for payments outside this website. You will be banned and your VIP or virtual currency completely forfeited, if you do so. Refunds will not be given for buyers remorse.

20. In-Chat Games and Virtual Currency (Gold)

#1 Chat Avenue offers games within the chat — which may include dice, a slot machine, a spin wheel, and room lotteries — as part of the chat experience. The following terms apply to those games and to Gold:

• The games are for entertainment only. They are a feature of the chat room, not a product in their own right.
• These games are not gambling. No real money is ever staked on them and no real-money prize can ever be won. The only thing at stake is Gold, which has no monetary value.
• Gold has no cash value and is not property. Holding Gold gives you no ownership right and no entitlement to money. It is a revocable licence to use a feature inside the chat, and nothing more.
• Gold cannot be sold, traded for money, transferred off our platform, redeemed, or withdrawn. Buying or selling Gold for real money, on or off this website, is prohibited and will result in removal of the accounts involved.
• Where Gold or VIP can be purchased, your payment is for access to features within the chat, not for a store of value, and is non-refundable except where a refund is required by law.
• If your account is banned, your entire Gold balance is forfeited and no compensation of any kind is due.
• We may adjust, reset, or remove Gold balances where we identify cheating, exploitation of a fault in a game, automated or scripted play, or a payment dispute or chargeback.
• We may change, suspend, or discontinue any game, or the Gold system itself, at any time, without notice and without compensation.
• Game outcomes are final. We do not restore Gold lost through play, through a disconnection, or through your own mistake.

21. Your Content

"Your content" means anything you post or transmit through this platform — messages, images, profile pictures, background images, webcam and voice, forum and blog posts, and your username.

• You keep ownership of your content. We do not claim to own it, and we do not sell it.
• By posting it, you grant #1 Chat Avenue a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, transmit, and distribute that content for the purpose of operating this service — which is simply what allows your messages to reach the people you are talking to and your pictures to appear on your profile.
• That licence also covers moderating your content: examining it, flagging it, removing it, and retaining what we must retain in order to enforce these Terms, to keep enforcement records, and to meet our legal obligations — including preserving and reporting child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
• This licence does not mean we archive your conversations. We do not store logs of chat conversations. What we keep, and for how long, is set out in our Privacy Policy.
• You confirm that the content is yours to post — that you own it or have the rights you need, and that posting it does not infringe anyone else's rights or break the law.
• We may remove, refuse, or restrict any content at any time, with or without notice, and we are not obliged to store or return it to you.
• The licence ends when the content is removed from the platform, except to the extent we must keep a copy for the legal, safety, and enforcement purposes described above.

22. Account Security

Your account is yours, and keeping it secure is partly your responsibility:

• Keep your password to yourself. You are responsible for activity that takes place under your account.
• Do not share your account or let anyone else use it. One account belongs to one person.
• Do not reuse a password from another website. If that site is breached, your account here is breached with it.
• We will never ask you for your password — not moderators, not administrators, not anyone claiming to work for us. Anyone who asks is trying to steal your account. Report them.
• Tell us immediately if you believe someone else has accessed your account.
• We may lock an account, force a password reset, or suspend access where we believe an account has been compromised or is being used by someone other than its owner.
• Creating additional accounts to evade a mute, kick, or ban is a violation of these Terms and will result in the removal of every account involved.

23. Acceptable Use of Our Systems

These rules protect the service itself. They apply to everyone, and we enforce them automatically as well as manually:

• No bots, scripts, or automated access. Do not use automated tools to register accounts, log in, post messages, send private messages, or interact with the chat in any way.
• No scraping, crawling, or harvesting. Do not collect user names, profile information, images, or any other data from this platform by automated means, and do not compile or republish it.
• No probing or testing our security. Do not scan, probe, or attempt to breach this platform, and do not attempt to access accounts, data, or areas that are not yours.
• No evading our controls. Do not attempt to bypass bans, blocks, rate limits, word filters, or any other enforcement measure, including by using proxies or VPNs to return after a ban.
• No interfering with the service — no flooding, no deliberate overloading, and nothing intended to disrupt the platform or other users' access to it.
• No malware. Do not upload, post, or link to anything designed to harm a device, steal credentials, or compromise an account.
• We use automated systems to detect this activity, and we may block, rate-limit, or permanently ban accounts, devices, and networks engaged in it, without notice.

24. If Someone Is at Risk of Harm

Sometimes a conversation stops being about the chat room. If someone talks about hurting themselves, about suicide, or about being hurt by another person, take it seriously and tell a moderator straight away. You will never be in trouble for reporting something like this, and you do not need to be certain — it is always better to tell us.

• Report it immediately using the in-chat reporting tools, or by sending a private message to a moderator.
• Our moderators may intervene in the conversation, remove content, or contact the user directly.
• Where we believe there is a credible risk to someone's life or safety, we may contact emergency services or law enforcement and provide them with the information we hold, as described in our Privacy Policy.
• Encouraging, instructing, or pressuring another person to harm themselves is prohibited and results in immediate removal of the account.

25. Suspension, Termination and Complaints

Our right to suspend or remove an account. We may mute, kick, suspend, or permanently remove any account, at any time, with or without notice, where we believe these Terms or a room's Rules have been broken, or where it is necessary to protect other users. We may also remove content without removing the account.

• Most enforcement is graduated — a warning, a mute, a kick, then a ban — but we are not required to warn you first.
• The most serious categories carry no warning at all and result in an immediate permanent ban: child sexual abuse material, the sexual solicitation or grooming of a minor, and the advertising or trading of such material.
• If your account is removed, your Gold balance is forfeited and no refund is due, including for any unexpired VIP.
• You may stop using the service at any time. If you want your account removed, contact us using the form below.

How to complain or appeal. If you think we have got something wrong, tell us. That includes a moderator decision, a mute, a kick, a ban, content we removed, or content we did not remove after you reported it. There are three ways to reach us:

• Our contact form — the best route if you are banned and cannot get into the chat.
• Our chat forums, where you can raise it with staff.
• Directly with a moderator — look for the shield icon at the top of the user list and send a private message. This route is only available if you are not banned; if you are, use the contact form or the forums.

It helps us if you include your username, the room, roughly when it happened, and what you think went wrong. We will look at it and reply. A decision may be upheld, reduced, or reversed, and where we got it wrong we will say so and put it right.

27. Changes to our Terms of Service
